These Terms of Use ("Terms") govern your access to and use of the Pethart website (the "Site") and any purchase you make through it. By using the Site, you agree to these Terms.
1. About This Agreement
The Site is operated by JGJ Global Holding LLC, a Wyoming limited liability company, located at 30 N Gould St, STE R, Sheridan, WY 82801, USA ("Pethart," "we," "us"). Ecomma FZCO is Pethart's outsourced brand and growth agency and is not a party to any transaction between you and Pethart.
2. Product Sourcing and Reseller Disclosure
Pethart is a retailer. We select, curate, and quality-review the products we sell, but we do not manufacture them. Products are sourced from third-party manufacturers and suppliers, including fulfilment partners accessed through DSers and CJ Trading. Any manufacturer's warranty applicable to a product is provided by the manufacturer, not by Pethart. To the maximum extent permitted by law, Pethart's responsibility for a defective product is limited to the remedies described in our Refund & Return Policy (replacement or refund), and Pethart disclaims liability for indirect or consequential damages arising from product defects, subject to Section 10 below.
3. Eligibility
You must be at least 18 years old, or the age of majority in your state, and able to form a binding contract to make a purchase on this Site. The Site is not directed at children under 13, and we do not knowingly collect personal information from children under 13 (see our Privacy Policy, Section 7).
4. Products, Pricing, and Availability
We attempt to display product information and pricing accurately, but errors can occur. If a product is listed at an incorrect price or with incorrect information due to a typographical, pricing, or technical error, we reserve the right to cancel any order placed for that product, whether or not the order has been confirmed, and to refund any amount charged. Product availability is not guaranteed until your order is confirmed.
5. Orders and Payment
Placing an order is an offer to purchase, which we may accept or decline. Payment is processed by Shopify Payments. You represent that any payment information you provide is accurate and that you are authorized to use the payment method submitted.
6. Intellectual Property
The Site and its content — including the Pethart name, logo, product photography, copy, and design — are owned by Pethart or its licensors and protected by intellectual property law. You may not copy, reproduce, or use these materials without our written permission, except for ordinary personal use of the Site to browse and purchase products.
7. Acceptable Use
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to the Site, our systems, or other users' accounts.
- Use automated means (bots, scrapers) to access the Site without our written permission.
- Interfere with the Site's operation or security.
- Submit false, fraudulent, or misleading information, including in orders or reviews.
8. Third-Party Links and Services
The Site may link to or integrate with third-party services (e.g., payment processors, review platforms, social media). We are not responsible for the content, policies, or practices of third-party sites, and your use of them is governed by their own terms.
9. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Pethart's total liability for any claim arising from your use of the Site or purchase of a product will not exceed the amount you paid for the product giving rise to the claim. Pethart is not liable for indirect, incidental, special, or consequential damages.
11. Indemnification
You agree to indemnify and hold Pethart harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles.
13. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted to this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
